Welcome to PicForge AI. These Terms of Service (“Terms”) govern your access to and use of the PicForge AI website, products, AI image generation tools, image transformation tools, subscription plans, credits, and related services (collectively, the “Service”).
By accessing or using PicForge AI, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
PicForge AI is an AI-powered image generation and image transformation platform. Our Service allows users to create, edit, transform, and download AI-generated images using text prompts, uploaded images, style presets, and supported AI models.

Credits may be required to generate, transform, upscale, download, or otherwise process images. The number of credits required may vary depending on the selected model, image size, quality level, feature, or generation type.
Subscription plans may include a monthly credit allowance and additional benefits such as faster generation, higher resolution, watermark-free downloads, or longer image history retention.

Payment processing may be handled by third-party payment providers, including Creem. By making a purchase, you agree to the applicable payment provider’s terms and policies.
Because PicForge AI provides digital products, AI generation services, and instantly delivered credits, payments are generally non-refundable unless required by applicable law or explicitly stated otherwise.
You may cancel your subscription according to the cancellation flow provided in your account, billing portal, or payment provider portal. Canceling a subscription stops future renewals but does not automatically refund previous charges.
We reserve the right to issue refunds, credits, or account adjustments at our discretion.
“User Content” means any text prompts, uploaded images, input images, reference images, generated images, edited images, metadata, or other materials you submit to or create through the Service.
You retain any rights you may have in your User Content. By using the Service, you grant PicForge AI a limited, worldwide, non-exclusive, royalty-free license to host, process, store, reproduce, modify, display, and transmit your User Content solely as necessary to provide, operate, improve, secure, and support the Service.

AI-generated content may be inaccurate, unexpected, offensive, incomplete, or unsuitable for your intended use. You are responsible for reviewing any generated output before using, publishing, selling, or distributing it.
PicForge AI does not guarantee that generated images will be unique, copyrightable, commercially usable, non-infringing, or suitable for any specific purpose.
You are solely responsible for determining whether your use of generated images complies with applicable laws, platform rules, advertising policies, intellectual property rights, privacy rights, and publicity rights.
This Acceptable Use Policy is part of these Terms and applies to all use of PicForge AI.
PicForge AI is designed for safe, lawful, and creative image generation. You may not use the Service to create, upload, request, generate, transform, distribute, sell, or promote content that violates this policy.

You may not use PicForge AI to create, upload, request, generate, transform, distribute, or promote content intended to deceive, mislead, defame, impersonate, or manipulate others.
This includes, but is not limited to:
You may not attempt to bypass, disable, manipulate, reverse engineer, or interfere with PicForge AI’s safety systems, content filters, prompt moderation, rate limits, payment systems, access controls, or security mechanisms.
You may not use prompt injection, obfuscation, coded language, alternate spellings, or other techniques to evade content moderation.
To maintain a safe and compliant platform, PicForge AI may use automated and manual moderation systems to review prompts, uploaded images, generated images, and related metadata.
For prompt-based image generation and image transformation, user-submitted prompts may be screened before being sent to AI generation models. If a prompt violates our policies, the generation request may be blocked.

Subject to your compliance with these Terms, your subscription plan, and applicable laws, you may use generated images for personal or commercial purposes.
However, commercial use is at your own risk. You are responsible for verifying that your generated images are suitable for commercial use and do not infringe third-party rights, violate advertising policies, mislead consumers, or breach any applicable laws.
PicForge AI does not provide legal clearance for generated content.
We strive to provide a reliable Service, but we do not guarantee that PicForge AI will be uninterrupted, error-free, secure, or available at all times.
The Service may be unavailable due to maintenance, updates, outages, third-party service failures, model provider limitations, abuse prevention, security incidents, or other reasons.
We are not liable for any loss resulting from service interruptions, generation failures, delays, or unavailable features.
PicForge AI may rely on third-party providers for payment processing, AI models, hosting, storage, analytics, authentication, email delivery, content moderation, and other infrastructure.
Your use of the Service may involve third-party services that are subject to their own terms, policies, and privacy practices.
We are not responsible for third-party services, outages, decisions, or policies.
PicForge AI, including its website, interface, software, design, logos, trademarks, features, and original content, is owned by PicForge AI or its licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service unless expressly permitted by us.

Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to PicForge AI in the 3 months before the event giving rise to the claim, or USD $100, whichever is greater.
